Terms of Service

1. Acceptance of Terms

By accessing or using Pathos Panel (“the Service”), you agree to be bound by these Terms of Service. If you are agreeing on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Description of Service

Pathos Panel is a panel management software platform that enables market research companies to recruit, manage, engage, and reward research panelists. The Service includes panel administration, survey distribution, rewards management, analytics, and API access.

3. User Accounts

• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One person or entity may not maintain more than one account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any portion of the Service
• Submit fraudulent survey responses or manipulate panel data
• Create multiple accounts to circumvent restrictions or earn duplicate rewards
• Use automated tools to interact with the Service without prior written consent
• Reverse engineer, decompile, or disassemble any part of the Service

5. Subscription & Payment

For research company clients:

• Subscription fees are billed monthly or annually as agreed
• All fees are non-refundable unless otherwise stated in your service agreement
• We reserve the right to modify pricing with 30 days notice
• Overdue accounts may have Service access suspended after 15 days

6. Panelist Rewards

• Points are earned by completing surveys and through referral programs
• Points have no cash value and cannot be transferred between accounts
• We reserve the right to adjust point balances in cases of fraud or system errors
• Reward redemptions are processed within 5-10 business days
• Inactive accounts (no login for 12 months) may have Points expired

7. Intellectual Property

The Service, including all software, design, text, and graphics, is owned by Pathos Panel and protected by intellectual property laws. Your subscription grants you a non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Data Ownership

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to process your data as necessary to provide the Service. We will not use your proprietary research data for any purpose other than delivering the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Pathos Panel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

10. Termination

Either party may terminate the Service agreement with 30 days written notice. We reserve the right to suspend or terminate accounts that violate these Terms immediately. Upon termination, your data will be made available for export for 30 days, after which it will be deleted.
